Data basis for catering webshops
The following information does not constitute legal advice and may be incomplete, but is intended as a guide. Make sure you are also legally protected.
The legal requirements must be observed for web shops and other public offers. Many details can also be found elsewhere in this documentation, but not all requirements and variants can be covered here. Some key points, for voting:
-
Any information that you do not want to or cannot store in the data can be added by adding text to the images.
-
The basic price/ base price and deposit (such as litres and kilos) must already be visible in the first view of an item selection (list).
-
In the case of pre-packaged foodstuffs such as a drinks can, "all relevant information" on the item must also be included in your item text, including the distributor, (contractual partner) etc.
-
The alcohol content and nutritional values must be stated, as well as allergens and additives.
-
An imprint must be available so that all locations are listed, and cookie notices and legal conditions must also be included.
-
The user must be aware of exactly with whom he is concluding a purchase contract for each order, please note the location settings in eSolutions.
The term remote communication technology
Remote communication technology: is any means of communication that can be used to conclude a contract between a consumer and a supplier without the simultaneous physical presence of the contracting parties."
-
In any case, our webshop falls under remote communication technology.
-
The SOT can also fall under remote communication technology, possibly with the option of booking self-collection. Of course, the installation location and the possible availability of service staff may play a role, but your legal advisor would have to judge this.
Requirements for the list of ingredients
In the EU, allergens must be clearly emphasised in lists of ingredients for products sold online. This concerns allergens such as cereals containing gluten, crustaceans, eggs, fish, peanuts, soya, milk (including lactose), nuts, celery, mustard, sesame seeds, sulphur dioxide and sulphites, sweet lupins and molluscs. Highlighting can be done by bold print, underlining or other visual means to ensure that consumers can easily recognise this information (source: IHK_DE).

The labelling of allergens serves to protect people with food allergies or food intolerances and is an important aspect of food safety in the EU. These regulations ensure that consumers receive the information they need to make informed decisions about the purchase and consumption of food.
